This page (combined with our Privacy Policy) provides you with relevant information about us and the legal Terms and Conditions (Terms) on which we sell any of the products (Products) shown on our website (our site) to you.
These Terms apply to any contract between us for the sale of Products to you (Contract). Please read these Terms carefully and ensure that you understand them clearly, before ordering any Products from our site. By ordering any of our Products, you agree to be bound by these Terms and other documents expressly referred to in them. By using our website, you accept and agree to our Privacy Policy.
By using our site, you confirm that you accept these Terms and that you agree to comply with them. If you do not agree to these Terms, you must not use our site. Use of our site includes accessing, browsing, subscribing for information or shopping on it.
Please note that we amend these Terms from time to time as set out in clause 4. Every time you intend to order Products from our site, please check these Terms to ensure you understand the terms that will apply at that time.
1 Our Products
1.1 While we do our best, we cannot guarantee that images on our website exactly represent actual products or their packaging. In particular, the colours shown on the website may not exactly represent the colours of our products because the colours shown on the website depend on the colour reproduction of your computer or mobile device.
1.2 All Products portrayed on our site are subject to availability. An order can be rejected if the Product is not in stock or no longer available.
1.3 We reserve the right to reject any order of Products you place with us for any reason. For example, we may reject your order if we know or suspect that you intend to resell some or all of the products specified in your order as a part of a commercial business. You may only place orders via this website for private and domestic purposes.
1.4 We expressly prohibit purchases of our Products for resale and/or reselling any EZ Houseware product as part of any business (including any online business) unless agreed in writing by EZ Houseware.
2 Use of Personal Information
Our use of your personal information is subject to our Privacy Policy. Please take the time to read our Privacy Policy as it contains terms relevant and applicable to you.
3 Use of Our Site
3.1 Your actions and use of our site are governed by our Terms of Website Use.
3.2 Our site is intended to provide general information about our goods and services, including making purchases via our site. While we do our best to supply accurate information on this site, errors and omissions may occur. We do not accept any liability to you or any third parties for any loss or damage which may directly or indirectly result from your use of our site or your access to, or inability to access, the site. Including viruses alleged to have been caused by our site and your reliance on any advice, opinion, information, representation or omission (whether negligent or not) contained on the website.
3.3 By using the website, you agree that you are using our site at your own risk and that you are solely responsible for the actions you take in reliance on the content displayed on, or accessed through, the site.
3.4 You must not misuse our site by deliberately introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site. By breaching this provision, you could commit a criminal offence under the Crimes Act 1961. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In this event, your right to use our site will cease immediately.
4 Our Right to Revise these Terms
4.1 We hold the right to revise these Terms from time to time in response to changes in:
- our delivery process;
- how we accept payment from you; and
- relevant laws, regulations, and requirements
4.2 Every time in which you order Products from us, the Terms in force at that time will automatically apply to the Contract between you and us.
4.3 In accordance with clause 4, whenever we revise our Terms, we will update you through a clear statement that these Terms have been amended and show the relevant date at the top of this page. Please check this page from time to time to take note of any changes as they are binding to you.
5 Contract Between You and Us
5.1 Our order process allows you to check ad revise any errors or changes you desire before confirming and submitting your order to us. Please carefully read and check your order to prevent errors.
5.2 After you place an order, you will receive a confirmation email from us acknowledging that your order has been received and seen. Please note that this does not mean your order has been accepted as we have the right to decline according to clauses 1.2 and/or 1.3. Our acceptance of your order will occur as described in clause 5.3.
5.3 We will confirm our acceptance of your order by sending you an email portraying that the Product(s) have been dispatched (Dispatch Confirmation). Please note that the Contract between us will only be formed upon sending you the Dispatch Confirmation.
5.4 If we are unable to provide you with a Product in accordance with clause 1.2, in which a Product is no longer available or in stock, this will be stated in our email to you. If you have already paid for the product, we will refund you the full amount as soon as possible.
6 Age
You may only purchase Products from our site if you are at least 18 years old.
7 Right of Return
Information regarding your right to return Products is outlined in our Returns Policy.
8 Delivery
8.1 We will aim to deliver the Products to you within 10 business days from the date you place your order. However, due to the pandemic, shipping times can be delayed for up to two weeks. It's a busy time, but we're working closely with our delivery partners to ensure your order arrives safely to you.
8.2 We will notify you of the expected delivery date and any changes in the Dispatch Confirmation via email.
8.3 Only when the Products arrive at the address you provided to us will delivery be completed.
8.4 The Products will be your responsibility once they have arrived at the address you have provided to us.
8.5 If no one is available at your address to receive the delivery, it is your responsibility to contact the relevant courier and rearrange the delivery. This turn of events will not reflect on us nor is it due to any fault of ours in accordance with clause 8.4.
9 Payment
Payment for the Product(s) is in advance, specifically at the time you place your order.
10 Liability
10.1 If we fail to follow through with these Terms, we are not responsible for any damage or loss that is not foreseeable.
10.2 All images, trademarks (including logos, text, graphics), Products and other content appearing on this site are the property of their respective owners and are protected by copyright, trade mark and other intellectual property laws. The use of any of EZ Houseware trademarks is strictly prohibited unless we provide prior written consent. You agree not to use any images, trademarks (including logos, text, graphics), Products and other content of ours for any commercial, business or resale purposes, and we shall have no liability to you for any loss of profit, loss of business or business opportunity, or business interruption.
11 Events Outside Our Control
11.1 We will not be liable or responsible for any failure to perform or delay in performance of, any of our obligations under a Contract that is caused by an Event Outside of Our Control.
11.2 An Event Outside Our Control means any act or event beyond our reasonable control, including without limitation strikes, privacy breach, lockouts or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disasters, or failure of public or private telecommunications networks.
11.3 If an Event Outside Our Control occurs that affects the performance of our obligations under a Contract:
(a) we will contact you as soon as reasonably possible to inform you; and
(b) our obligations under a Contract will be suspended and the time for performance of our obligations will be extended for the duration of the Event Outside Our Control. In the case that the Event Outside Our Control affects our delivery of Products to you, we will rearrange a new delivery date with you after the Event Outside Our Control is over.
12 Other Terms
12.1 This Contract is between you and us. No other person shall have any rights to enforce any of its terms.
12.2 You may only transfer your rights or your obligations under these Terms to another person if we agree in writing. We will send you a copy of the agreement at our discretion.
12.3 Each of the paragraphs of these Terms operates separately. If any court or relevant authority determines that any of them are unlawful or unenforceable, the remaining paragraphs will remain in full force and effect.
12.4 These Terms are governed by New Zealand law. Meaning that a Contract for the purchase of Products through our site and any dispute or claim arising out of or in connection with it will be governed by New Zealand law. You and we both agree that the courts of New Zealand will have non-exclusive jurisdiction.
12.5 Information on this website is subject to change without notice.
12.6 The inclusion of any hyperlinks to third-party websites does not imply EZ Houseware endorsement or approval of such third parties, their websites, businesses or other activities. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials, websites, products, or services. Any issues arising in relation to hyperlinks of the third parties must be taken up directly with the third party.
12.7 Unless otherwise indicated, copyright in the information on this site is owned by or licensed to EZ Houseware. This site or any portion of this site may not be reproduced, duplicated, copied, sold, or otherwise exploited for any commercial purpose except where necessary for viewing this site on your Internet browser, or where specifically authorised by law or in writing by EZ Houseware.
12.8 Our status as the authors of content on our site must always be acknowledged.
12.9 If you print off, copy or download any part of our site in breach of these terms, your right to use our site will cease immediately and you must, at our discretion, return or destroy any copies of the materials you have made.
